THIS DOCUMENT OUTLINES THE GENERAL TERMS AND CONDITIONS ("Terms") under which Kakiyo ("Kakiyo," "we," "us," or "our") provides access to its website (https://www.kakiyo.com) and its application (https://app.kakiyo.com) and related services (collectively, the "Services"). By using our Services, you ("User," "you," "your," or "Client") agree to comply with and be bound by these Terms.
PLEASE READ THESE TERMS CAREFULLY. BY SUBSCRIBING TO, ACCESSING, OR USING OUR WEBSITE OR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ AND AGREE TO BE BOUND BY THE CURRENT VERSION OF THE FOLLOWING DOCUMENTS.
GDPR & Data Protection — Kakiyo is fully GDPR-compliant and registered in the EU (Estonia). Your data is processed lawfully and you retain full rights to access, modify, or delete your personal information at any time. These terms reflect our commitment to transparency and user protection.
About Kakiyo and These Terms
Kakiyo
Kakiyo is an AI-powered platform that connects to the User's LinkedIn account to perform outreach and manage prospecting conversations on their behalf. Kakiyo is a conversation management and outreach execution tool. No specific results, outcomes, or performance are guaranteed.
Definitions
- Services: All features, tools, and functionalities provided by Kakiyo
- User: Any individual or entity using our Services
- Account: Your registered profile and access credentials
- AI: Artificial intelligence technology powering our platform
- Content: All data, messages, and information processed through our Services
- Data: Personal and business information collected or processed
- Subscription Plan: Your chosen service tier and billing arrangement
- Payment Method: Your designated payment source for subscription fees
- Term: The duration of your service agreement
How You Accept These Terms
Agreement to Terms
By accessing or using our Services, you enter into a binding legal contract with Kakiyo and agree to comply with these Terms.
Account Usage and Compliance
You must own and have full control over the LinkedIn account used with our Services. You are responsible for ensuring compliance with LinkedIn's Terms of Service.
User Eligibility
You must be at least 18 years old and have the legal authority to enter into this agreement on behalf of yourself or your organization.
Prohibited Actions
- Using the Services for illegal or unauthorized purposes
- Attempting to reverse engineer or hack our platform
- Sharing account credentials with unauthorized parties
- Using the Services to send spam or malicious content
- Violating any applicable laws or regulations
Subscription Plans
Available Plans
Kakiyo offers three subscription plans: Pioneer, Hunter, and Conquer. Each plan is subject to the billing, cancellation, and refund terms outlined in these Terms.
Pioneer Plan and Free Trial
A 14-day free trial is available exclusively on the Pioneer plan. A valid payment method is required at signup. By providing a payment method, the User explicitly acknowledges that their subscription will automatically convert to a paid Pioneer plan at the end of the trial period unless canceled before that date through the dashboard. Each LinkedIn account is eligible for one Pioneer free trial only.
Hunter and Conquer Plans
The Hunter and Conquer plans carry no free trial period. Users who subscribe to either plan are entering a paid subscription immediately upon signup. By subscribing to Hunter or Conquer, the User explicitly acknowledges they are entering a paid subscription with immediate effect and irrevocably waive any right to a refund from the moment the subscription is activated.
Free Trial Terms
Trial Period and User Options
During the 14-day free trial on the Pioneer plan, the User has two options only: cancel the trial through the dashboard before it ends, or activate the paid plan early. No other options exist.
Early Paid Plan Activation
If the User chooses to activate the paid plan before the trial ends, this constitutes an explicit, voluntary, and informed decision to enter a paid subscription immediately. This action is irreversible. No refunds will be issued under any circumstances following early activation of a paid plan. By clicking to activate the paid plan, the User confirms they understand they are waiving their remaining trial period and consenting to an immediate charge.
Reminder Notices
Kakiyo sends an automated reminder email 7 days before the end of the free trial period to notify the User of the upcoming charge. This email is provided as a courtesy only and includes a direct link to manage or cancel the subscription at https://app.kakiyo.com/billing. Receipt or non-receipt of this reminder email does not alter the User's sole responsibility to cancel before the trial ends. The User's cancellation obligation exists independently of whether reminder emails were received, opened, or read.
Trial Conversion
Once the free trial period ends and the subscription converts to a paid plan automatically, the User explicitly and irrevocably waives any right to a refund. The 14-day free trial constitutes sufficient opportunity to evaluate the Services and make an informed decision. No refunds will be issued after trial conversion under any circumstances.
Cancellation Policy
Cancellation Responsibility
The User is solely and exclusively responsible for canceling their subscription. Cancellation must be performed directly through the account dashboard at https://app.kakiyo.com/billing. Contacting customer support, sending an email, or any other form of communication does not constitute cancellation and will not be processed as such. Kakiyo bears no responsibility for any charges incurred as a result of the User's failure to cancel through the designated self-serve cancellation method in the dashboard.
Cancellation Timing
To avoid being charged, the User must cancel before the end of their free trial or before their next billing date. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time within a billing period.
Recurring Billing and Payment
Automatic Renewal
All subscriptions automatically renew on a monthly basis unless canceled by the User prior to the renewal date through the dashboard at https://app.kakiyo.com/billing. By providing a payment method and accepting these Terms, the User explicitly acknowledges and consents to recurring monthly charges until the subscription is canceled.
Billing Disclosure
The User acknowledges at the time of signup that: the subscription is recurring; charges will be made automatically each billing cycle; the User is solely responsible for canceling before the next billing date to avoid charges; and that acceptance of these Terms constitutes informed consent to all future charges made in accordance with the applicable subscription plan.
Renewal Reminder Notices
Kakiyo sends an automated reminder email 7 days before each monthly renewal date. This email includes a direct link to manage or cancel the subscription at https://app.kakiyo.com/billing. All invoices are sent to the email address registered on the User's billing account. Receipt or non-receipt of renewal reminder emails does not alter the User's sole responsibility to cancel before the renewal date if they do not wish to be charged.
Failed Payments and Retries
If a payment fails, Stripe will automatically retry the charge multiple times before the subscription is suspended. The subscription remains fully active throughout the entire retry period. A failed payment does not constitute cancellation. The User remains responsible for any charges successfully collected during the retry process. Kakiyo will send an email notification when a payment fails. If the User does not wish to be charged, they must cancel their subscription through the dashboard regardless of any payment failures or pending retries.
No Refund Policy
All payments are final and non-refundable across all plans. Kakiyo does not issue refunds for any reason including but not limited to: failure to cancel before renewal, failure to cancel before trial conversion, early activation of a paid plan, dissatisfaction with the Services, partial use of a billing period, or failure to use the Services during an active subscription period.
Subscription Fees
All subscription fees are billed monthly in advance through Stripe. Payments are due immediately upon subscription activation.
Invoice Disputes
Any billing disputes must be reported within 30 days of the invoice date. Disputes reported after this period will not be considered.
Price Changes
We may change our pricing with 30 days' written notice. Continued use of Services after price changes constitutes acceptance of new rates.
Payment Methods
You must provide a valid payment method and maintain current billing information. You authorize us to charge your payment method for all applicable fees.
Chargeback Policy
Chargebacks and Payment Disputes
By accepting these Terms, the User agrees that all charges made in accordance with their subscription plan and these Terms are authorized charges. Initiating a chargeback or payment dispute for any charge made in accordance with these Terms constitutes a breach of this agreement. In the event of a chargeback, Kakiyo reserves the right to immediately terminate the User's account, pursue recovery of the disputed amount including all associated processing and chargeback fees, and submit these Terms, billing records, communication history, and proof of service usage to Stripe and the relevant financial institution as evidence that the charge was fully authorized and compliant with the agreed Terms.
Binding Acceptance at Signup
Acceptance Confirmation
By subscribing to any Kakiyo plan and providing a payment method, the User confirms they have read, understood, and agreed to these Terms in their entirety, including all billing, cancellation, and refund policies. This acceptance is recorded at the moment of signup via explicit checkbox confirmation and constitutes a legally enforceable agreement. Acceptance of these Terms is a condition of access to the Services and cannot be undone retroactively.
What Kakiyo's Services Include
Definition of Services
Kakiyo is a platform that connects an AI agent to the User's LinkedIn account to perform outreach and manage prospecting conversations on their behalf. Kakiyo is strictly a conversation management and outreach execution tool. It is not a lead generation guarantee, a meeting booking service, or a sales results platform.
Lead Finder
Kakiyo includes a Lead Finder feature that allows Users to identify and source prospects. A set number of Lead Finder credits are included with each subscription plan. Additional credits can be purchased separately. The Lead Finder is an optional feature and its use is entirely at the User's discretion.
Outreach and Conversation Management
When connected to the User's LinkedIn account and provided with a prospect list, Kakiyo will: send connection invites to prospects not already in the User's network on their behalf; skip the invite step for prospects already connected; upon acceptance of a connection invite, gather personalized information and unique data points from the prospect's profile; and initiate and manage conversations with prospects based on the AI instructions provided by the User.
User Authorization to Operate on LinkedIn Account
By connecting their LinkedIn account to Kakiyo, the User explicitly, knowingly, and irrevocably grants Kakiyo full and unrestricted authorization to access and perform any and all actions on their LinkedIn account, without limitation, for the purpose of providing the Services as described in these Terms and any future features or functionalities Kakiyo may introduce. This authorization explicitly excludes any actions that would alter the User's account credentials, login information, password, account settings, personal identity information, or anything that would affect the fundamental ownership or identity of the account. The User confirms that they are the sole owner of the connected LinkedIn account and that they have full legal authority to grant this authorization. Kakiyo's operation on the User's account is performed entirely at the User's request and on the User's behalf. The User bears full and sole responsibility for all actions performed on their LinkedIn account through the use of Kakiyo, and Kakiyo accepts no liability for any consequences arising from those actions.
No Results Guarantee
Kakiyo makes no guarantee of any kind regarding results, outcomes, or performance. This includes but is not limited to: replies from prospects, accepted connection invites, booked meetings, qualified leads, generated revenue, or any other business outcome. Results depend entirely on factors outside Kakiyo's control, including but not limited to: the quality and recency of the User's prospect list, the relevance of the User's targeting and ICP (Ideal Customer Profile), the quality and optimization of the User's LinkedIn profile, the industry and market being targeted, the AI instructions and prompts configured by the User, and the behavior and responsiveness of prospects.
AI Instructions and Prompts
Kakiyo provides default AI prompts as a starting point. The User is responsible for reviewing, testing, and refining all AI instructions before going live. Kakiyo offers a conversation simulation feature that allows Users to test and iterate on their AI instructions prior to execution. Kakiyo bears no responsibility for results generated using default prompts or custom prompts created by the User. The User is solely responsible for the quality, appropriateness, and effectiveness of all AI instructions used on the platform, whether provided by Kakiyo as defaults or written by the User.
User Responsibility for Outcomes
The User acknowledges and accepts that the effectiveness of Kakiyo is directly dependent on the quality of their inputs, including their prospect list, their targeting criteria, their LinkedIn profile, and their AI instructions. Kakiyo is a tool. Like any tool, its results depend entirely on how it is used. Kakiyo accepts no liability for poor results, no results, or unintended outcomes arising from the use of the platform.
Third-Party Platform Risk and LinkedIn Account Liability
Kakiyo operates in connection with third-party platforms including LinkedIn. The User acknowledges that the use of any third-party tool or service in connection with their LinkedIn account carries inherent risks. Kakiyo accepts no responsibility whatsoever for any consequences arising from the use of our platform in connection with the User's LinkedIn account. This includes but is not limited to: account restriction, account suspension, account ban, account deletion, reduced reach or visibility, drops in Social Selling Index (SSI) score, shadow restrictions, loss of connections, loss of data, or any other limitation or penalty imposed by LinkedIn or any other third-party platform, whether temporary or permanent, regardless of the cause. The User is solely and exclusively responsible for ensuring that their use of Kakiyo complies with the terms, policies, and guidelines of LinkedIn and any other third-party platform they connect to our Services. Kakiyo bears no liability for any direct, indirect, or consequential losses arising from actions taken by LinkedIn or any third-party platform against the User's account.
Service Updates
We reserve the right to modify, update, or discontinue any aspect of our Services at any time with or without notice.
Your Responsibilities as a User
Account and Authentication
You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.
Compliance
You must comply with all applicable laws, regulations, and LinkedIn's Terms of Service when using our Services.
Prohibited Conduct
- Sending unsolicited or inappropriate messages
- Misrepresenting your identity or business
- Attempting to circumvent platform limitations
- Engaging in harassment or discriminatory behavior
LinkedIn Profile Requirements
You must maintain an accurate, complete, and professional LinkedIn profile that complies with LinkedIn's community guidelines.
Account Security
You must implement appropriate security measures to protect your account and immediately notify us of any unauthorized access.
How Kakiyo Handles Your Data
Data Ownership
Kakiyo owns all data collected, processed, or generated through the use of our Services, including but not limited to prospect information, conversation data, and usage analytics.
User Consent
By using our Services, you waive any rights to data collected through our platform and consent to our data processing activities as outlined in our Privacy Policy.
Data Processing
We process data in compliance with GDPR requirements, including: lawful basis for processing, data minimization principles, purpose limitation, storage limitation, accuracy requirements, and security measures.
Data Security
We implement industry-standard security measures to protect data from unauthorized access, disclosure, or destruction.
Data Retention
We retain data for as long as necessary to provide our Services and comply with legal obligations.
User Access to Data
You may request access to your personal data in accordance with applicable data protection laws.
Data Breach Notification
We will notify affected users of any data breaches in accordance with applicable legal requirements.
Third-Party Data Processing
We may engage third-party service providers to process data on our behalf under appropriate data processing agreements.
Intellectual Property Rights
Ownership
Kakiyo owns all intellectual property rights in and to: all software, algorithms, AI models, and technical infrastructure; all AI prompts, templates, and conversation frameworks; all content, design, and functionality of our website and application; all brand names, logos, and identifying marks; and all original content, documentation, and creative works.
License
We grant you a limited, non-exclusive, non-transferable license to use our Services solely for your LinkedIn account management and prospecting activities.
Restrictions
You may not copy, modify, distribute, sell, or lease any part of our Services or included software, nor may you reverse engineer or attempt to extract the source code.
Feedback
Any feedback, suggestions, or ideas you provide to us become our property and may be used without compensation or attribution.
Third-Party Services
Our Services may integrate with third-party platforms. We do not claim ownership of third-party intellectual property.
Liability Limitations and Disclaimers
User Responsibility
You are fully responsible for all content generated by our AI and all consequences of using our Services. You assume all liability for AI-generated messages and interactions.
Disclaimer of Warranties
Our Services are provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
Limitation of Liability
Our liability is limited to the amount you paid for Services in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
Indemnification
You agree to indemnify and hold harmless Kakiyo from any claims, damages, or expenses arising from your use of our Services or violation of these Terms.
How Services Can Be Terminated
Suspension or Termination by Kakiyo
We may suspend or terminate your access to our Services immediately and without notice for: violation of these Terms, non-payment of fees, fraudulent or illegal activity, abuse of our Services, LinkedIn account suspension or termination, or any reason at our sole discretion.
User Termination
You may terminate your account at any time by canceling through the dashboard at https://app.kakiyo.com/billing. Termination does not entitle you to any refunds.
Effect of Termination
Upon termination, your access to Services will cease immediately. All data may be deleted, and you remain liable for any outstanding fees.
Reactivation of Accounts
Reactivation of terminated accounts is at our sole discretion and may require payment of all outstanding fees.
When These Terms May Change
Right to Modify
We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting to our website.
Notification
We will notify users of material changes via email or through our platform. It is your responsibility to review Terms regularly.
Continued Use
Your continued use of our Services after changes constitutes acceptance of the modified Terms.
Review and Acceptance
You have 30 days from notification to review changes. If you disagree with modifications, you must terminate your account.
Governing Law and Dispute Resolution
Governing Law
These Terms are governed by the laws of the Republic of Estonia. Any disputes will be subject to the exclusive jurisdiction of Estonian courts.
Dispute Resolution
All disputes must be resolved through binding arbitration in accordance with Estonian arbitration rules.
Arbitration Procedures
Arbitration will be conducted by a single arbitrator appointed by mutual agreement. The arbitrator's decision is final and binding. Each party bears their own costs unless otherwise determined by the arbitrator.
Exception to Arbitration
Either party may seek injunctive relief in court to protect intellectual property rights or prevent irreparable harm.

Confidentiality Obligations
Confidential Information
Confidential information includes all non-public information about our business, technology, customers, and operations disclosed during your use of our Services.
Exclusions
Information is not confidential if it is publicly available, independently developed, or rightfully received from third parties without confidentiality restrictions.
Obligations
You agree to maintain confidentiality, use information solely for authorized purposes, and implement reasonable security measures to protect confidential information.
Duration of Confidentiality
Confidentiality obligations survive termination of these Terms and continue for 5 years from disclosure.
Force Majeure and Exceptional Circumstances
Events of Force Majeure
Force majeure events include natural disasters, wars, terrorism, government actions, labor disputes, or other circumstances beyond our reasonable control.
Consequences
During force majeure events, our obligations under these Terms may be suspended without liability for the duration of the event.
Termination
If a force majeure event continues for more than 30 days, either party may terminate these Terms with written notice.
Additional Legal Provisions
Transfer of the Agreement
You may not transfer or assign your rights under these Terms without our written consent. We may transfer our rights at any time.
Subcontracting
We may engage third-party contractors to provide Services, subject to appropriate confidentiality and security obligations.
Entire Agreement
These Terms constitute the entire agreement between parties and supersede all prior agreements, representations, and understandings.
Severability
If any provision is found invalid or unenforceable, the remaining provisions continue in full force and effect.
Waiver
Waiver of any provision must be in writing. No waiver of any provision constitutes a waiver of any other provision or future waiver.
Notices
All notices must be in writing and delivered to the addresses specified in these Terms or as updated by the parties.
Governing Language
These Terms are written in English. In case of translation conflicts, the English version prevails.
